Regardless of your opinion on the issue of guns in society, there are some changes coming in Texas that we will all have to recognize and adapt to. Effective January 1, 2016, Texans with a license to carry a handgun will have the right to openly carry their handguns in locations that allow open carry. This also impacts the current law on concealed carry. There is an excellent article on this issue in the November edition of TEXAS REALTOR magazine.
There are several important aspects to this worth explaining:
Only licensed individuals will be allowed to open or concealed carry. The licensing requirement remains the same as before.
It is illegal for a licensed person who is intoxicated to carry, open or concealed.
Certain places will be restricted and not allow either open or concealed carry. These include amusement parks, places of worship, meetings of government entities, and private-property that has been restricted by its owner(s). This latter group must provide verbal or written notification of the restriction.
Private-property owners much be clear on what exactly they are restricting. The options are: open carry only, concealed carry only, or both open and concealed carry.
This is not a sign that Texas is going back to its Wild West roots as many people imply. In actuality, Texas will be joining 44 other states that currently allow some form of open carry of handguns.
So what impact will this change have on real estate professionals? It means that we will have to be prepared to deal with people who might open carry at an open house or showing. We will need to ask our sellers if they wish to allow or restrict the carrying of handguns on their property, whether it be open or concealed. And brokers will need to have a published and enforced policy on handguns for their agents.
